Terms of Service

1. The HAVN Hunt Platform

HAVN Hunt, LLC ("HAVN," "we," "us") provides an online marketplace that connects landowners ("Hosts") who have property available for recreational use with individuals seeking to access such property ("Guests") for hunting and outdoor activities (collectively, the "Services").

CRITICAL DISCLAIMER: HAVN Hunt is a platform provider, not a real estate broker, travel agency, or hunting guide service. We do not own, inspect, control, or manage the Properties listed. We are not a party to any agreement entered into between Hosts and Guests.

2. Host Obligations & Warranties

By listing a Property on HAVN Hunt, you represent and warrant that:

• Ownership: You are the legal owner of the Property or have explicit, written legal authority to grant access rights to third parties.
• Accuracy: All information provided (location, boundaries, acres, hazards) is accurate. You verify that the GPS boundaries provided match your legal deed.
• Safety: You have disclosed all known latent dangers (e.g., open wells, aggressive livestock) on the listing.
• Compliance: Your listing does not violate any HOA rules, zoning laws, or conservation easements.

We use third-party tools (e.g., RentCast, Stripe Identity) to verify your identity and ownership. However, you remain solely responsible for the accuracy of your listing. If a Guest is charged with trespassing due to inaccurate boundaries provided by you, you agree to indemnify and defend HAVN Hunt and the Guest.

3. Guest Obligations

As a Guest, you agree to:

• Licensing: Possess a valid state hunting license and tags for the specific game and season.
• Safety: Adhere to all firearm safety rules and property-specific rules set by the Host.
• Liability Waiver: Sign the mandatory "Release of Liability" agreement for every booking. Access is denied until this is signed.
• "As-Is" Condition: Acknowledge that hunting land is wild terrain. You accept the risk of uneven ground, wildlife, and weather.

4. Fees and Payments

HAVN Hunt charges a Service Fee to Guests and/or a Platform Fee to Hosts. All fees are disclosed prior to booking. Payments are processed via Stripe. Payouts to Hosts are released typically the following month after the booking start date, subject to security holds.

5. Cancellations and Refunds

Cancellation Policy: Hunting seasons are time-sensitive and inventory is limited. To protect our Landowners, HAVN Hunt enforces the following strict cancellation tiers based on the Booking Start Date:

• 14+ Days Prior: 100% Refund of the Booking Cost, minus a 3.5% Transaction Processing Fee.
• 7 to 13 Days Prior: 50% Refund of the Booking Cost. Service Fees are non-refundable.
• Less than 7 Days (or "Day Of"): No Refund.

Processing Refunds: All refund requests must be submitted via the app or to support@havnhunt.com. Refunds are processed manually to ensure accuracy. Please allow 5-10 business days for funds to appear in your account depending on your bank.

Extenuating Circumstances: HAVN Hunt reserves the right to override this policy in documented cases of: (a) Official government closures of the hunting unit; (b) Severe weather events rendering the property inaccessible; or (c) Death in the immediate family.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAVN HUNT, LLC SHALL NOT BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR SERVICE INTERRUPTION, OR FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY OR EMOTIONAL DISTRESS ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

IN NO EVENT WILL HAVN HUNT'S AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE FEES YOU PAID OR RECIEVED IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

7. Governing Law and Venue

These Terms are governed by the laws of the State of Utah. Any dispute related to these Terms shall be resolved exclusively in the state or federal courts located in Utah County, Utah.
