TERMS OF SERVICE & MASTER RELEASE OF LIABILITY

IMPORTANT LEGAL NOTICE: By accessing the HAVN Hunt platform, you are agreeing to a binding contract. This document includes a Master Release of Liability, an Assumption of Risk, a Broad Indemnification (including a Duty to Defend), and a Waiver of Ordinary Negligence. If you do not agree to these terms, you may not use this platform.

1. Platform Role and "Access Only" Clarification

HAVN Hunt, LLC ("HAVN Hunt") operates strictly as a technology platform connecting property owners ("Landowners") with outdoor enthusiasts ("Guests"). You expressly acknowledge that the fees paid through this platform are for ACCESS ONLY.

HAVN Hunt does not own, lease, inspect, manage, or control the properties listed. We do not provide "guaranteed safety," "land maintenance," or "guide services." We do not coordinate, supervise, or ensure the spatial separation of concurrent hunting parties.

2. The Dynamic Waiver Architecture

To comply with state-specific Agritourism and Recreational Use Statutes, every booking processed through HAVN Hunt generates a dynamically fortified, cryptographically hashed Master Release of Liability Agreement. This agreement consists of a Core Contract and a State-Specific Addendum based on the property's location.

3. Capacity Models and Assumption of Risk

Depending on the specific rules set by the Landowner, your booking will fall into one of three distinct capacity models. You agree to assume all inherent risks associated with your specific model:

Single-Party Hunting: You assume the inherent risks of the wilderness, including but not limited to firearms/archery malfunction, hazardous terrain, unpredictable wildlife, and severe weather.
Multi-Party Hunting: You acknowledge that the property allows concurrent access to unguided third-party guests. You assume the absolute, non-delegable duty to positively identify targets and proactively establish a safe zone of fire. You assume the risk of the actions, inactions, intoxication, or negligence of other unguided guests, including crossfire and target misidentification.
Non-Consumptive (Photography/Scouting): You agree that you are strictly prohibited from bringing, carrying, or discharging any firearms or archery equipment on the property.

4. Waiver of Ordinary Negligence

In consideration of being permitted to access the property, you, for yourself, your heirs, and assigns, DO HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Landowner and HAVN Hunt (the "Released Parties") from any and all liability, claims, or demands arising out of any injury, death, or property damage, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES OR OTHERS. This waiver applies strictly to Ordinary Negligence and does not extend to Gross Negligence or Willful Misconduct.

5. Broad Indemnification and Duty to Defend

You agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from any costs, damages, or lawsuits (including reasonable attorney fees) arising from your actions, your breach of Property Rules, or any injury you cause to third parties (including other concurrent guests). Your "Duty to Defend" obligation means you must pay for the Released Parties' legal counsel immediately upon the filing of any such claim.

6. Account Verification and State Licensure

You must be at least 18 years of age to create an account. Landowners must verify their identity via Stripe Identity. Hunters attest under penalty of perjury that they hold a valid state hunting license for the jurisdiction of their booking and will abide by all state game laws.

7. Fees and Payments

HAVN Hunt charges a Service Fee to Guests and/or a Platform Fee to Hosts. All fees are disclosed prior to booking. Payments are processed via Stripe. Payouts to Hosts are released typically the following month after the booking start date, subject to security holds.

8. Cancellations and Refunds

Cancellation Policy: Hunting seasons are time-sensitive and inventory is limited. To protect our Landowners, HAVN Hunt enforces the following strict cancellation tiers based on the Booking Start Date:

14+ Days Prior: 100% Refund of the Booking Cost, minus a 3.5% Transaction Processing Fee.
7 to 13 Days Prior: 50% Refund of the Booking Cost. Service Fees are non-refundable.
Less than 7 Days (or "Day Of"): No Refund.

Processing Refunds: All refund requests must be submitted via the app or to support@havnhunt.com. Refunds are processed manually to ensure accuracy. Please allow 5-10 business days for funds to appear in your account depending on your bank.

Extenuating Circumstances: HAVN Hunt reserves the right to override this policy in documented cases of: (a) Official government closures of the hunting unit; (b) Severe weather events rendering the property inaccessible; or (c) Death in the immediate family.

9. Governing Law, Venue, and Severability

This Agreement shall be governed by the laws of the State of Utah. Any legal suit or proceeding arising out of or related to this Agreement shall be instituted EXCLUSIVELY in the federal or state courts located in the City of Provo and County of Utah. You voluntarily waive any objection to venue in Utah County, Utah.
